Commercial litigation - what are my options?

We will always strive to handle your disputes outside of the courtroom where possible but, if it is necessary to take court action, there are several options available.

  • Ordinary Cause and Summary Cause procedures

    Commercial disputes are either heard in Sheriff Court or the Court of Session. If the value of your claim is over £5,000, we will proceed with the Ordinary Cause procedure. Those under £5,000 follow what is known as the Summary Cause procedure.

  • Simple procedure

    To reduce the amount of time it takes to settle a dispute, it may be possible to use the simple procedure. The simple procedure can be used where the value of your claim is less than £5,000 and relates to the possession or delivery of ‘moveable property (such as stock, goods etc.) Our lawyers can advise as to whether this might be suitable for your circumstances.

  • High-value cases

    If your case is of an exceptionally high value, it may also be heard in the Court of Session Commercial Court. We will ensure that we strategically plan the right course of action for you and your business.
