Why making a Will matters more than you think

Why making a Will matters more than you think

Let’s be honest, making a Will isn’t top of most people’s to-do list. It’s one of those things we often put off, for all sorts of reasons: “I’m too young.” “Now’s not the right time.” “It’s a bit morbid.” “I don’t have much to leave anyway.”

Sound familiar? If so, you’re not alone. According to recent research, 53% of Scots aged 50 and over don’t have a valid Will

At Ness Gallagher, we see firsthand the difference having a Will makes – and the confusion and stress that can follow when someone passes away without one.

If you die without a Will in Scotland, your estate is dealt with under the laws of intestacy. That means the law decides who inherits what – not you. This might lead to:

  • Family members you wouldn’t have chosen inheriting everything.
  • Partners or stepchildren getting nothing, especially if you're unmarried.
  • Delays and legal costs for your loved ones at an already difficult time.
  • Disputes that can cause lasting rifts in families.

Many people assume their estate will just "automatically" go to their spouse, children, or partner, but the law doesn’t always work that way. And crucially, cohabiting partners have no automatic right to inherit, even if you’ve been together for years.

Wills aren’t just for the elderly or the wealthy. They're for anyone who wants peace of mind and control over what happens to their estate, whether that’s money, property, or even sentimental keepsakes.

Life changes quickly – relationships, children, property, and careers. A Will gives you a way to stay in control, no matter what the future holds. And once it’s done, it’s done (although you can update it at any time as life and circumstances change – and again, it is important to ensure you do update it if there has been a major change in your life). It's often a quicker and more affordable process than people expect, especially with the right advice.

At Ness Gallagher, we make the process straightforward and personal. Whether you’re just starting to think about it, or you’ve been meaning to get round to it for years, we’re here to help with expert advice on Wills, Powers of Attorney and planning for the future - whatever age or stage you're at.
