First time buyers – the legal steps you need to know

Buying a home is an exciting milestone, but it can also feel overwhelming, particularly if you are a first time buyer or are new to buying property in Scotland (where the legal process differs from the rest of the UK). Understanding the key legal steps involved can help you feel more confident and avoid costly mistakes.

Step 1: Getting your finances in order. Before you begin house hunting, it’s important to understand your budget. This usually involves securing a mortgage agreement in principle, considering additional costs such as Land and Buildings Transaction Tax (a tax due on homes over £145,000), legal fees, and registration dues, as well as setting aside funds for moving expenses and other household items.

Step 2: Understanding the Home Report. In Scotland, sellers are required to provide a Home Report before marketing a property. This includes a Single Survey (condition and valuation of the property), an energy report, and a property questionnaire, and will help you before submitting an offer.

Step 3: Making an offer. Offers in Scotland are normally submitted in writing by a solicitor. This is a crucial stage where legal expertise is particularly valuable. As well as submitting a formal written offer on your behalf, we will include appropriate conditions, and advise on closing dates and competitive bidding situations. In a popular market, properties may go to a closing date, where multiple offers are considered by the seller.

Step 4: Concluding missives. Once an offer is accepted, solicitors for both parties exchange a series of letters known as missives which set out the final terms of the contract. In Scotland, a legally binding contract is formed once missives are concluded – often much earlier than buyers expect. At this point, both parties are legally committed to the transaction.

Step 5: Title checks and legal due diligence. Your solicitor will carry out a range of essential checks, including examining the title deeds, checking for burdens, servitudes, or restrictions affecting the property, and conducting property searches with the local authority, to ensure there are no legal issues that could affect your ownership or future use of the property.

Step 6: Mortgage, LBTT and registration. Once missives are concluded we will coordinate with your lender to arrange the mortgage funds, calculate and submit LBTT (if applicable) and then the title to the property will be registered in your name in the Land Register of Scotland. First-time buyers may benefit from LBTT relief, and we will advise whether this applies to your purchase.

Step 7: Settlement and getting the keys. On the date of entry, the purchase price is paid, ownership transfers to you, and you receive the keys to your new home. We will ensure everything goes smoothly, funds are transferred safely and the transaction completes correctly.
